Thank you for choosing Algorithm Digital Marketing (“Algorithm”) to provide digital marketing services. By making payment for any package or services offered by Algorithm, you agree to the following Terms and Conditions (“Terms”). Payment processing represents your acknowledgment and acceptance of these Terms. Please review these carefully.
1. Scope of Services
Services Provided: Algorithm offers digital marketing services tailored to client needs, which may include, but are not limited to, SEO, paid advertising, content marketing, and analytics reporting.
Custom Deliverables: The scope of work is defined by the purchased package. Any additional work outside the agreed scope will require a separate agreement and may incur additional fees.
Additional Services: Additional services not included in the package will be billed at $175 per hour unless otherwise agreed upon in writing.
2. Term and Termination
Effective Date and Duration: These Terms take effect upon receipt of the first payment and remain valid until terminated by either party.
Termination:
- Managed Services: A 60-day written notice is required, along with a 30-day remediation period to resolve issues.
- Pulse Analytics Subscriptions: Cancel anytime by following these steps

- Log in to your account on the Stripe Customer Portal.
- Navigate to the subscription management section.
- Select “Cancel Subscription.”

- Add-on Projects: Must be paid upfront; cancellations are not eligible for refunds.
3. Payment Terms
Monthly Retainer: Payments are due on the 1st of each month for services rendered. Late payments and bounceback payments will incur a 1.5% monthly interest fee and any bank fees associated from failed payment.
Additional Costs: Expenses not covered under the package (e.g., travel, licensing fees, media costs) will be billed separately. Expenses exceeding $250 require prior client approval.
Non-Refundable Fees: All payments are non-refundable.
4. Client Responsibilities and Indemnification
Accuracy and Approvals: Clients must provide accurate and complete information. Delays in approvals may affect project timelines.
Compliance: Clients are responsible for ensuring all materials comply with applicable laws, including intellectual property and advertising regulations.
Indemnification: Clients agree to indemnify Algorithm against claims arising from materials or data provided by the client.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary and sensitive information. A separate Mutual Confidentiality Agreement (“MCA”) may apply.
6. Non-Solicitation
Clients agree not to solicit or hire Algorithm employees or contractors during the engagement and for one year after its conclusion. Breach of this term results in liquidated damages equal to the individual’s gross compensation for the preceding 12 months, plus legal fees.
7. Use of Client Name and Materials
With prior written approval, Algorithm may use the client’s name and marketing materials in its portfolio and promotional efforts. Clients retain the right to approve all uses of their name or materials.
8. Limitation of Liability
Algorithm is not liable for:
- Legal or regulatory consequences from the client’s failure to maintain accurate Privacy Policies or Terms & Conditions.
- Issues resulting from the client’s incorrect or incomplete implementation of deliverables.
- Outcomes based on Algorithm’s data-driven recommendations.
9. Purchasing Agents
Algorithm may act as an agent to procure third-party services or materials for the project. Clients are responsible for reimbursing these costs. Ownership of materials transfers to the client upon full payment.
10. Invoicing Process
Billing Cycle: Where applicable monthly retainers are invoiced at the start of the month. Additional expenses appear on the next month’s invoice.
Payment Terms: Invoices are due within 30 days. Late payments will result in service interruptions.
11. Changes to Terms
Algorithm reserves the right to update these Terms at any time. Updates will be communicated via email or the Algorithm website. Continued use of services constitutes acceptance of the revised Terms.
12. Compliance with Laws
Both parties agree to comply with all applicable laws and regulations.

Pulse Analytics Terms of Service

Pulse Analytics is a product of Algorithm Digital Marketing (“Algorithm”). By using Pulse Analytics, you agree to the following Terms of Service (“Terms”). Please read these Terms carefully. If you do not agree with them, do not use our services.
1. Scope of Services
Pulse Analytics provides a platform for tracking, analyzing, and presenting marketing data to assist in making data-driven decisions. On your behalf, Algorithm may implement tracking solutions on your website to facilitate this service.
- Your Responsibility: It is your responsibility to ensure that your website’s Privacy Policy and Terms & Conditions are up-to-date and comply with applicable laws based on the geographies you target. Algorithm is not responsible for drafting or maintaining these legal documents for you. Consult a legal representative for guidance tailored to your business needs.
- Limitations: Deliverables are limited to the services outlined in the tier selected. Algorithm is not responsible for results beyond the scope of the chosen package unless additional services are purchased and scoped separately.
2. Privacy and Tracking
By using Pulse Analytics, you grant Algorithm permission to implement tracking mechanisms on your website. These tools collect data to generate insights specific to your business.
- Your Responsibility:

- Ensure compliance with applicable privacy laws (e.g., GDPR, CCPA).

3. Subscription and Cancellation
Pulse Analytics operates on a subscription basis with the following terms:
- No Refund Policy: Fees paid are non-refundable.
- Cancellation:

Upon cancellation, access will remain active until the end of the current billing period. Subscriptions will not renew after cancellation, and no further billing will occur.

- Issues resulting from incorrect or incomplete implementation of tracking mechanisms on your website.

Databox aggregates and syncs analytics data from integrations such as Salesforce, Google Ads, and Google Analytics 4. The data is organized into “Metrics,” which include a date, value, and optional dimensions or currency units.
Security and Compliance
Databox leverages Amazon AWS infrastructure, which is certified with:
